Terms of Use
1 Acceptance of Terms
By downloading, accessing, or continuing to use the Chartzy mobile application ("App"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. Your continued use of the App at any time constitutes your acceptance of these Terms and any updates made to them. If you do not agree, please discontinue use of the App immediately.
These Terms apply to all users of Chartzy, regardless of platform (iOS or Android).
2 What Chartzy Is
Chartzy is a personal care management application designed to help caregivers stay organized. It allows you to track medications, feeding schedules, appointments, care notes, supply changes, and more all in one secure place.
3 Eligibility
Chartzy is intended for users who are 18 years of age or older. By using the App, you confirm that you meet this requirement and are legally capable of entering into a binding agreement. If you are using the App to manage care for a dependent, you confirm you have the legal authority to do so on their behalf.
4 Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please use a strong, unique password and do not share your login with others. If you believe your account has been accessed without your authorization, contact us immediately at info@chartzy.net.
5 Subscriptions and Payments
Chartzy is free to download and includes a 14-day free trial. After the trial, access continues through an in-app subscription. By subscribing, you agree to the following:
- Subscriptions are billed monthly or annually depending on your selected plan
- Subscriptions automatically renew unless canceled at least 24 hours before the renewal date
- To cancel on iPhone: Settings then Apple ID then Subscriptions
- To cancel on Android: Google Play then Payments and Subscriptions
- All billing is processed by Apple App Store or Google Play. Chartzy does not handle payments directly
- Refund requests are managed by your app store and subject to their policies
Subscription pricing is displayed at the time of purchase in the App Store or Google Play and may be subject to change.
6 Caregiver Access
You may invite additional caregivers to access your account with limited permissions. You are solely responsible for managing who has access and for revoking access when appropriate. Chartzy is not liable for how invited caregivers use or share information once access has been granted.
7 Your Data
You retain ownership of all data you enter into Chartzy. We use your data solely to provide the App's services to you. For complete details on how your data is collected, stored, and protected, please read our Privacy Policy.
8 Acceptable Use
You agree to use Chartzy only for its intended purpose and in compliance with all applicable laws. You may not:
- Use the App for any unlawful or fraudulent purpose
- Attempt to access, tamper with, or disrupt our systems or servers
- Share, sell, or transfer your account access to any other person
- Upload or transmit malicious code or harmful content of any kind
- Use the App in any manner that could harm, harass, or endanger other users
9 Intellectual Property
Chartzy and all of its content including the app design, features, branding, and underlying code are the intellectual property of Chartzy LLC. Nothing in these Terms transfers any ownership rights to you. You may not copy, reproduce, modify, or redistribute any part of the App without prior written permission from Chartzy LLC.
10 Disclaimer of Warranties
We make every effort to keep Chartzy reliable and available. However, the App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee the App will be uninterrupted, error-free, or free from security vulnerabilities at all times.
11 Limitation of Liability
To the fullest extent permitted by applicable law, Chartzy LLC shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of or inability to use the App. Our total aggregate liability to you shall not exceed the amount you paid to Chartzy LLC in the twelve (12) months preceding the claim.
12 Termination
You may stop using the App and delete your account at any time. We reserve the right to suspend or terminate your access if you violate these Terms. Upon termination, your right to use the App ceases immediately.
13 Updates to These Terms
We may update these Terms from time to time to reflect changes in the App, our practices, or applicable law. When we do, we will update the "Last Updated" date at the top of this page. You can always review the current version on our website at chartzy.net or in the app under About. Your continued use of the App after any updates constitutes your acceptance of the revised Terms.
14 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts of the State of California.
