1 Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of the Chartzy mobile application ("App"), developed and operated by Chartzy LLC ("we," "us," "our"). By downloading, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

2 Purpose of the App

Chartzy is a health management tool to help users log and organize health-related data, including:

• Medication schedules
• Feeding times and quantities
• Ventilator use and sprint sessions
• Medical appointments
• Custom notes and caregiver activity

3 User Eligibility

You must be at least 18 years old, have full legal capacity to enter into these Terms, and not be barred from using the App under any applicable law. If you are using the App on behalf of another individual (e.g., a child or dependent adult), you must have legal authority to do so.

4 User Accounts & Security

You are responsible for providing accurate and complete account information, maintaining confidentiality of your login credentials, and all activity under your account. We may suspend or delete accounts that violate these Terms.

5 Subscription & Payment Terms

Chartzy offers subscription plans (monthly and annual) with prices listed in the App Store / Google Play listing.

• Subscriptions auto-renew unless canceled at least 24 hours before the renewal date
• Apple cancellation: Settings → Apple ID → Subscriptions
• Google cancellation: Google Play → Payments & Subscriptions
• All payments and refunds are handled by the app store provider; Chartzy does not process refunds directly
• Free trial periods will automatically convert to a paid subscription unless canceled before the trial ends
• Current pricing is displayed in the App Store or Google Play at the time of purchase and may be subject to change

6 Data Collection & Privacy

We collect personal, health-related, and device information as described in our Privacy Policy. While we take steps to safeguard your data, Chartzy is not a HIPAA-covered entity and does not guarantee HIPAA compliance. Do not store protected health information unless you consent to this.

7 Caregiver Access & Permissions

You may invite caregivers with limited access to your account. You are responsible for managing caregiver permissions appropriately, ensuring shared information complies with applicable privacy laws, and revoking access when necessary. Chartzy is not liable for misuse of data by caregivers once access is granted.

8 Prohibited Uses

You agree not to:

• Use the App for unlawful purposes
• Attempt to disrupt App operations
• Share, sell, or sublicense your access
• Upload malware or harmful code

9 Intellectual Property

All content in the App is owned by Chartzy LLC. You may not reproduce, distribute, or exploit any part of the App without prior written consent.

10 Disclaimers

• No Medical Advice: The App is for informational purposes only
• No Warranty: Provided "as is" without warranties of any kind
• User Responsibility: You are solely responsible for any actions taken based on information in the App

11 Limitation of Liability

To the fullest extent allowed by law, Chartzy LLC is not liable for direct, indirect, incidental, or consequential damages arising from your use of the App.

12 Termination

We may terminate or suspend your account at any time for violations of these Terms. Upon termination, your right to use the App ends immediately.

13 Modifications to Terms

We may update these Terms at any time. Continued use after updates constitutes acceptance.

14 Governing Law

These Terms are governed by the laws of California, USA. Any disputes will be handled exclusively in the courts of California, USA.
